About the Consumer Areas of Practice Section
The Consumer Areas of Practice Section was created to address several practice areas and topics not squarely covered by other Academy sections, divisions or groups. These subjects include: construction defects; insurers' bad faith; toxic mold; environmental litigation; consumer litigation (e.g., predatory lending, lemon laws); condemnation; class actions, stockholder/investor fraud; mandatory arbitration; and whistleblower/qui tam laws. The Section is designed to serve as a resource in these areas for both its members and other Academy members seeking advice or information. It plans to offer CLE programs on these topics, maintain an active listserv and promote legislative reforms advantageous to North Carolina consumers, policy holders and homeowners.

WE'RE LOOKING FOR A FEW ACTIVE PEOPLE!

Are you interested in getting more actively involved in the Consumer Areas of Practice Section?

If so, there are three Consumer Areas of Practice Executive Committee positions available for the upcoming year...

MEMBERSHIP CHAIR: Primary duties would be to work with Consumer Areas of Practice Section Chair and Academy staff to build membership to the Consumer Areas of Practice Section.

CLE CHAIR: Primary duties would be to work with the Consumer Areas of Practice Section Chair and Academy staff in developing Consumer Areas of Practice Section CLEs.

PAC CHAIR: Primary duties would be to work with Consumer Areas of Practice Section Chair and Academy staff to involve Section members in supporting PAC.

THE FORECLOSURE PROJECT
As homeowners are facing foreclosure in record numbers in North Carolina, the NC Justice Center and Legal Aid of North Carolina have requested the Academy's help in defending these homeowners in the foreclosure process. This is a call for volunteers! Please read below for project details.

More than 2 million people with subprime loans, which are typically granted to people with less than perfect credit, are facing foreclosure this year and nearly 20 percent of subprime mortgages issued between 2005 and 2006 are projected to fail. Our state's legal aid programs simply cannot handle the volume of these cases alone.

What are we asking for your help with?

We are requesting that attorneys represent individual homeowners who are being threatened with foreclosure or have received a notice of foreclosure hearing. You will be receiving an email with details about this project this week. Training and sample pleadings will also be provided to interested volunteers. Volunteers' responsibilities will be limited to defending foreclosures; negotiating with lender(s); and evaluating a client's affirmative remedies. You would not be asked to file civil actions as part of this program. Attorneys at Legal Aid, who have developed expertise in this area, will represent cases in which a civil suit is necessary.
